Welcome to Taratxt. We provide software and services that help you build and operate your own SMS gateway using your own hardware and SIM. By creating an account, accessing, or using Taratxt, you agree to these Terms of Service (“Terms”).
If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization.
1. Definitions
- “Taratxt” / “Service”: our software, APIs, web app, documentation, and related services.
- “We/Us”: Taratxt.
- “You” / “Customer”: the individual or entity using Taratxt.
- “Device”: your hardware (e.g., modem, IoT, phone) configured to send/receive SMS using your SIM.
- “AUP”: our Acceptable Use Policy.
- “Refunds Policy”: our Refunds & Billing Policy.
2. Eligibility & Account
You must be legally capable of entering into a contract and comply with all applicable laws. Keep your credentials secure; you are responsible for activities under your account.
3. Service Nature; No Carrier Services
Taratxt is not a telecom operator and does not resell carrier services. You provide your own SIM and carrier plan. You are responsible for device safety, radio compliance, and network/operator rules.
4. Your Use of Taratxt
- Use the Service lawfully and in accordance with the AUP.
- Obtain and document recipient consent where required.
- Configure devices and webhooks securely; protect your tokens/keys.
- Keep your information accurate and up to date.
We may apply rate limits, block traffic, or suspend/terminate access for AUP violations, security risks, or service stability.
5. Automated Content-Safety Filtering
To protect users and comply with legal/carrier obligations, we use automated content-safety filtering on inbound/outbound messages to detect spam, scams, malware, and other prohibited content. Messages may be blocked, rate-limited, or flagged for review. Filtering is used solely for abuse prevention and service integrity. See AUP for details and the appeals path.
6. APIs, SDKs, Webhooks
- API Access: Use only documented endpoints; do not scrape or overload.
- Security: Keep tokens secret; rotate if compromised.
- Webhooks: Validate HMAC signatures where provided; do not use webhooks to circumvent the AUP.
- Fair Use: We may throttle or deny requests that degrade service.
7. Plans, Billing, Refunds
Paid features are billed by our payment processor. By upgrading, you authorize charges per the plan you select. Renewals, cancellations, and refunds are governed by our Refunds & Billing Policy. Taxes may apply based on your billing info.
8. Uptime & Support
We aim for high availability but do not guarantee uninterrupted service. Scheduled or emergency maintenance may occur. Support is provided via support@taratxt.com during posted hours.
9. Beta / Preview Features
We may offer experimental features marked as “beta,” “preview,” or similar. These are provided as-is, may change or discontinue at any time, and may be subject to different limits or policies.
10. Intellectual Property
We retain all rights in the Service, including software and branding. You retain rights in your data. Some components may be open source; their licenses govern your use of those components.
11. Your Data
We process data as described in our Privacy Policy. You are responsible for obtaining an appropriate legal basis for personal data you submit to or process through the Service.
12. Prohibited Conduct
- Reverse engineer, decompile, or create derivative works from the Service except as allowed by law.
- Interfere with or disrupt the Service or other users’ access.
- Use the Service to send unlawful, abusive, or infringing content.
- Attempt to circumvent security or abuse-prevention controls.
13. Suspension & Termination
We may suspend or terminate access for violations of these Terms, the AUP, law, or carrier policies, or for security/stability reasons. You may cancel at any time via your account settings; cancellations take effect at the end of the current paid term (see Refunds Policy).
14. Warranties & Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
16. Indemnification
You will indemnify and hold us harmless from claims arising from your use of the Service, your content, your devices, or your violation of these Terms, the AUP, or applicable laws.
17. Compliance; Export; Sanctions
You must comply with applicable export control and sanctions laws. You may not use the Service if you are subject to relevant trade restrictions.
18. Changes
We may update these Terms from time to time. If changes are material, we’ll provide notice (e.g., email or in-app). Continued use after the effective date constitutes acceptance.
19. Governing Law & Dispute Resolution
These Terms are governed by applicable law. Venue and jurisdiction will be determined as required by law in your location, unless otherwise specified by mandatory law.
